When is a felony not a felony in the USA? When it’s commited by a large corporation. So c’mon! Commit crimes against the American people. Apparently, we love it! Choice quote

the Department of Justice will not likely get involved, said Jennifer Granick

And we’re not even talking accidental here either. This is a willfully committed act! There’s no “oops, accidentaly tossed a rootkit on that CD we were distributing” get out of jail free card.
Seriously. The thing that disturbs me the most about the Sony rootkit fiasco is that they’re not being treated the same as if they had been a citizen commiting the same crime. The US Justice system selectively enforces laws against citizens only, apparently. We’d export you over to Botswana for “interrogation” if you created a rootkit that got on the .gov networks. Unless you’re Sony|BMG. Then you’re only liable for a few free CD coupons and a pat on the ass.
