While it’s been proven in US courts that it’s not illegal to sell trade marked keywords (as long as they don’t appear in the advertisement) someone’s taking a wack at google again over it.

Seems to me they should just throw in the towel and save on the lawyer fees.  I mean, c’mon, Happy Birthday ™ and every other phrase under the sun is trademarked by someone, at some point.  Pretty soon we won’t be able to converse for fear of infringement.

Or write, for that matter.
